    Up until more recent years, asbestos law did not exist because workers were not aware of the dangers they were at risk for. When entire communities located near asbestos companies started to show the deadly and serious effects that asbestos can cause is when asbestos law developed. The companies had known for years the deadly effects asbestos can cause but was able to avoid asbestos law because the public was unaware.

    Asbestos law has now become a very public topic. Most recently, on March 10, 2003 the Supreme Court ruled on asbestos law and monetary entitlement that railroad workers can receive. A controversial subject, asbestos law has uncovered that many companies have continued to allow workers to become exposed to asbestos and now many companies have gone bankrupt awarding the victims and surviving family members.                 Mineral asbestos is subject to many laws and regulations regarding its production and use, including mining, processing, use, and disposal. Injuries from asbestos have resulted in both workers' compensation and personal injury lawsuits. Health problems attributed to asbestos include asbestosis, mesothelioma, lung cancer, and pleural thickening.

            One of the main problems related to asbestos in civil litigation is the prevention of asbestos-related diseases. Many countries have statutes of limitations to prevent actions brought long after the cause of action has expired. For example, in Malaysia, the time limit for bringing a corruption claim is six years from the time the breach occurred. Due to many asbestos-related actions, countries such as Australia have changed their statutes of limitation to recover from the time of discovery rather than the time of the cause of action. The first worker to claim injury from exposure to asbestos in the workplace was in 1927, and the first lawsuit against an asbestos manufacturer was filed in 1929. Since then, many lawsuits have been filed. As a result of the lawsuit, the producers sold subsidiaries, diversified, produced asbestos substitutes, and started an asbestos export business.

       Around the world, 67 countries and territories (including those in the European Union) have banned the use of asbestos. It is listed as a category of controlled waste under Annex I of the Basel Convention on the Control of Transboundary Movement of Hazardous Wastes and their Disposal in 1992. This means that parties to the convention are required to prohibit the export of hazardous wastes to parties that have prohibited the import of such wastes via the notification procedure in Article 13 of the convention. In places such as India, however, there continues to be high use of friable or dust-based asbestos in compressed asbestos fiber (CAF) gaskets, ropes, cloth, gland packings, millboards, insulation, Brakes and other products are exported without proper knowledge and information to other countries. Asbestos use is widespread in India due to lack of legal enforcement.

        In the late 19th century at the beginning of the 20th century, Asbestos was considered very important for using the construction company. It is known to be very hot, to have higher electricity, but not expensive and easy to use.

            Asbestos hazards arise when the fibers become airborne and inhaled. Because the size of the fibers, the lungs can't expel them. These fibers are also sharp and penetrate the flesh.
Health problems from asbestos include:

  1.     Asbestosis - is a lung disease that was first diagnosed in textile workers, asbestosis is a lung tissue injury from the production of the growing material that stimulates the growth of the connective tissue from the respiratory tract. The scarring can eventually become so severe that the lungs can no longer function. The latency period (that is, the time it takes for the disease) is usually 10 to 20 years. 
  2.     Miscatelima - Cancer of Mucoothail in the heart, Perthoneum (the hole of the year), or the mystery of cancer, the Mursion is not associated with smoking. The only cause is exposure to asbestos or similar fibers. The lifespan of mesothelioma can be 20 to 50 years. 
  3.     The prognosis for mesothelioma is poor, with most patients dying within 12 months of diagnosis.
  4.      Cancer - Cancers of the lungs, gastrointestinal tract, kidneys, and larynx have been linked to asbestos. The waiting time for cancer is usually 15 to 30 years.
  5.      Pleural effusion.

Considerable international controversy exists regarding the perceived right to injury-related litigation regarding compensation related to asbestos exposure and subsequent health consequences claims. The two quotes below can be used to show some of the different views expressed in the legal and political system, the first from Prof. Lester Brickman, an American lawyer writing in the Pepperdine Law Review, and Michael Wills, a British MP, speaking in the House of Commons on July 13, 2006:

"A review of the scholarly literature shows a great indifference to the causes of the failure of this country's justice system. Most of the articles published on the asbestos case focus on the commercial costs and the way of money from the hands of defendants and plaintiffs and their lawyers. can be prioritized quickly and efficiently. Unable to recognize, let alone examine, the extreme facts of various claims and unsubstantiated claims that show a gap between the analysis and the reality of the prosecution which is almost a gap between the figure's claims for illness and the actual presentation of the illness”.

"Many of the people I see in my surgery work in many places that work and they can be exposed to asbestos in any of them, but medical science is such that no one can identify which of them is. Consequently. there has been a long and complicated history of legal discussions about how to distribute debt. Lawyers and judges have fought, with good cause and courage, against a difficult and complex law, but it has caused frustration for the families we represent. Many of the families that make up mine have been torn apart by lawsuits trying to get compensation for their ill health. That is cruel and unacceptable."
